Note: We do not intend to collect personal information from children. Our website and services are not directed to individuals under the age of 13, and we do not knowingly collect data from them. This includes sending service-related announcements (like notifications about your delivery schedule or changes to our services). For instance, we might email or call you about an order status or respond to a question you submitted through our website.
  • To Send Marketing and Promotional Materials: With your consent or as otherwise permitted by law, we may use your information to send promotional communications about our products or new services that might interest you. This could include email newsletters, special offers, or similar marketing messages. You have the choice to opt out of marketing communications at any time (see Your Rights & Choices below). We do not spam, and we will honor any request to unsubscribe or opt-out.
  • To Provide SMS Updates and Alerts: If you have opted in to our SMS messaging program, we will use your phone number to send you text message updates, such as delivery notifications, appointment reminders, service alerts, or important employee communications (for employees who subscribe). These messages are used to keep you informed in real-time about matters you’ve asked us to keep you updated on.   • For Internal Business Operations: We may use data (including aggregated, non-identifiable data) to analyze and improve our operations. For example, we might review website usage data to improve site performance or user experience, or use purchase history to manage inventory and logistics. Any affiliate that receives your information will also uphold the privacy protections described in this policy. This sharing is typically to streamline operations or manage your relationship with us (such as servicing an account through a local branch office in your region).
  • Legal Compliance and Protection: We will disclose personal information outside of our company if we have a good-faith belief that such disclosure is necessary to: comply with a law, regulation, legal process, or governmental request; enforce our agreements or policies; detect or prevent fraud, security, or technical issues; or protect the rights, property, and safety of Challenger, our customers, our employees, or the public. For instance, responding to a subpoena or providing information to law enforcement if required by law.
  • Business Transfers: If Challenger Pallet & Supply Inc. is involved in a merger, acquisition, bankruptcy, or sale of all or a portion of its assets, your information may be transferred as part of that transaction. We will ensure that any successor entity honors the commitments in this Privacy Policy or provides notice and choice to you if your data would be handled differently.
  • With Your Consent: Aside from the cases above, if we ever need to share your information for other purposes, we will describe it to you at the time and request your consent. You will have the opportunity to opt-in or opt-out before we share the information in such a case.

Again, we emphasize that we do not sell personal data. We also do not share your personal information with third-party companies for their own direct marketing use. All data sharing is limited to the purposes described here, or as required or permitted by law. Additionally, any information related to SMS communications (your mobile number and consent data) will not be shared with third parties for their own marketing or unrelated purposes, in line with our SMS terms.

Cookies and Tracking Technologies

Cookies: As noted, our website uses cookies, which are small text files stored on your browser or device. Cookies serve several functions:

  • Essential Cookies: These are necessary for the website to function properly, enabling core features like page navigation and access to secure areas. The site cannot function properly without these cookies.

At this time, there is no universal standard for recognizing or honoring DNT signals, and our site does not respond to these browser DNT signals. We continue to monitor developments around DNT and may update our practices if a standard emerges. SMS Messaging Terms & Conditions

We offer an SMS messaging service to keep our employees and customers informed. The following terms apply to our text messaging program (by opting in, you agree to these):

  • Program Description: Challenger provides SMS messaging services to communicate important updates to employees and customers. Messages may include, but are not limited to, delivery schedules, appointment reminders, service alerts, and employee communications. These texts are intended to provide you timely and relevant information regarding our services or your interaction with us.
  • Message Frequency: Message frequency varies and will depend on your interactions and our services needs. For example, you might receive more messages during an active delivery or service transaction, and fewer or no messages at other times. We strive to limit messages to only what is necessary or useful to you (for instance, an appointment reminder or a notice of a delivery truck en route).
  • Opt-In: You will only receive text messages from Challenger if you have opted in. By providing your mobile number and giving consent (through our website forms, during service sign-up, or even via verbal consent in person or over the phone), you agree to receive text messages from us. This opt-in could be part of an online form submission where you check a box to receive texts, part of a written service agreement, or a recorded verbal agreement when interacting with our team. We will not send you promotional SMS messages without your consent.
  • Opt-Out: You may opt out of our SMS messages at any time. To stop receiving texts, simply reply “STOP” to any Challenger message on your mobile device. Once we receive your STOP request, we will send a single confirmation text to let you know you have been unsubscribed. After this, you will not receive further SMS messages from us (unless you opt back in). Please allow a short time for your opt-out to be processed. There are no penalties or fees from us for opting out—your only cost would be standard messaging rates by your carrier (see Fees).
  • Help: If at any time you need assistance or more information regarding our SMS service, you can reply “HELP” to any Challenger text message. We will respond with a message on how to contact our support team or direct you to additional resources. You can also contact our customer service at any time via phone or email (see Contact Us below) for help with the SMS program.
  • Fees: Challenger does not charge you any additional fees for our SMS service, but standard message and data rates may apply. This means you may incur charges from your mobile carrier for text messages or data usage. The cost depends on your mobile phone plan (for instance, if you pay per text or have a limited texting plan, those rates will apply to messages from us). You are responsible for any such charges.
  • Privacy (SMS Program): We value your privacy. The phone number you provide for text messages will be used only for the purposes you agreed to. We will not sell or share your personal information for third-party marketing purposes. Your consent to receive texts is limited to Challenger communications. Please also review this full Privacy Policy for how your personal information is handled and protected in all our services.

These SMS Terms & Conditions are part of Challenger’s overall Privacy Policy and Terms of Service. By opting into the SMS program, you also agree to our general privacy and data practices as outlined in this Privacy Policy. Data Security

We take the security of your personal information seriously. Challenger implements a variety of technical and organizational security measures designed to protect your data from unauthorized access, disclosure, alteration, or destruction. These measures include physical safeguards (like secure facilities), administrative safeguards (such as limiting staff access to data on a need-to-know basis and training employees on data protection), and technical safeguards (including encryption of sensitive data, firewalls, and secure socket layer (SSL) technology to protect data during transmission).

 

While we strive to protect your information, please note that no method of transmission over the Internet or electronic storage is 100% secure. Thus, we cannot guarantee absolute security of your data. You share and transmit information at your own risk. If we ever experience a data breach involving your personal information, we will notify you and the appropriate authorities as required by law.

(Do note that even if you opt out of marketing, we may still send you essential transactional or service-related communications, such as an invoice, a shipment notification, or an important account notice, as these are not promotional.)

Challenger does not sell your personal information (as “sell” is defined under CCPA). If you are a California resident and send us a verifiable request regarding your data (for example, asking for a copy or deletion of your data), we will respond as required by law. Additionally, California’s “Shine the Light” law (Civil Code §1798.83) allows residents to request a notice disclosing what categories of personal information we have shared with third parties for their direct marketing purposes, if any. As stated, we do not share data with third parties for their own direct marketing, but you can contact us to request further information about any data sharing.
  • GDPR (EU/UK) Privacy Rights: If you are located in the European Union, United Kingdom, or a region with similar data protection laws, you have certain rights under the General Data Protection Regulation (GDPR) or equivalent laws.   • Other Region-Specific Rights: If you reside in a jurisdiction with specific privacy rights (for example, certain U.S. states or other countries with new privacy laws), you may have similar rights to access, delete, or correct your data. We will need to verify your identity before fulfilling certain requests (for example, a request for access or deletion) to ensure that we do not disclose or remove information improperly. Verification might involve confirming information we already have on file or asking for identification. We will respond to your request within the timeframe required by law (for instance, CCPA generally requires a response within 45 days for California residents). There is no fee for making a request, though in rare cases we may charge a reasonable fee or decline to comply if a request is manifestly unfounded or excessive (if permitted by law).
